                                                Terms & Conditions of Auction:
1.  All prospective bidders must register with clerk, providing adequate material identification (name and address) in order to obtain a bidding paddle.  Except for the bidders who have prearranged to have a permanent bidding paddle, all other paddle holders must return their paddles to the clerk before leaving the auction or they will be charged for same.  Bidders are advised not to leave their paddles unattended as the number holder will be responsible for any and all items charged to his number.  Please report any lost or stolen paddles to the clerk immediately.

2.  Pidgeon Auctions will endeavour to correctly describe and/or catalogue the items to be sold and at the time of sale will attempt to describe honestly any MAJOR damages or irregularities of which they are aware.  However, this must not be interpreted as to any form of warranty or guarantee as to the authenticity, genuineness, correctness of description, condition or age of the said items, and Pidgeon Auctions will not be held responsible for any discrepancies or inaccuracies relating to the said items, be it at the same or elsewhere in print or spoken.  All items are sold "as is, where is" except where otherwise expressed. Prospective bidders are urged to inspect the items before bidding in order to determine condition, age, etc.

3.  Title of each item offered for sale will pass to the highest bidder acknowledged by the Auctioneer, subject to conditions herein, and such bidder assumes all risk and responsibility of the said item immediately when sold. Merchandise must be paid for by CASH, APPROVED CHEQUE, INTERAC, VISA OR MASTERCARD (note--with the use of Visa or Mastercard, the 3% buyers premium is applicable) and must be paid the same day of the Auction and the items purchased must be removed from the premises at the buyer's expense that same day unless prior arrangements have been made for storage thereat or thereon.

4.  In the case of a disputed bid, the Auctioneer shall be the sole determinant as to who is the successful bidder and at his discretion may re-offer and resell the article in question if two or more independent paddle holders in the audience attest to witnessing any such advance bid in dispute which was not acknowledged by the Auctioneer.  If any dispute arises after the sale, the Auctioneer's sale record shall be conclusive as to who was the purchaser and as to the purchase price.

5.  Absentee or Phone Bids may, at the discretion and pre-arrangement of the Auctioneer, be accepted.  The under-bidder shall have the right to inquire as to the identity of the absentee or phone bidder.

6.  Operating, starting or tampering with any machinery or mechanical equipment at any auction is strictly prohibited and any breach of this notice will be at the sole and total risk of any violator.  Violation of this notice will absolve the owners and/or Auctioneers from any and all injury, damages or wrongful death. 

 7.  Persons attending an auction assume all risk of damage, theft, loss or accident to person and property and specifically relieve the Auctioneers, Owners, Consignors or anyone else connected with the Auction proceedings or with the ownership of the facility, or of any defect of the premises in or on which the auction sale is held and anything in or on the said premises.

8.  In accordance with the Harmonized Sales Tax Ruling, Auctioneers must charge 15% HST on all items sold in auction with the exception of books at which the rate is 7%; also certain farm machinery and/or equipment is totally exempt, which specific information may be obtained from the Auctioneers.  In the event of a vehicle transfer, payment of the HST will not be received by the Auctioneers but must be paid directly to the Registry of Motor Vehicles by the Purchaser when transferring ownership of the Vehicle.  Out-of-the-Country Purchasers may apply at the Canada-US Border for a rebate of HST paid to an Auctioneer and therefore foreign buyers are reminded to retain all Sales Slips for this purpose.  Also, for the convenience of Out-of-Country Purchasers, the Auctioneers will be available at the end of the auction (no charge)  to date and sign each Sales Slip according to the approximate age of the items so as to facilitate said Purchasers which completing taxation forms at the Border
